I live in California if there California laws to help me. I got the gift certificate from my mom which she got it from her workplace. The restarunt has recently changed owners. It has no expiration date, not to mention a date it was issued so it cant expire. It is in the same location and still is called by the same name as if it never changed owners. Under law do they have to accept it? What are my options? I will even call the BBB monday to see what they can do.
Well I went in and it was refused saying it was under a new owner now.
laws vary state to state but in the long run in most states when you buy a business you take on the responsibility of that business. they should honer that certificate,if they refuse the get in touch with the bbb

no. but usually they honor them out of goodwill for a short period of time. a gift cert. is a contract between the purchaser and the seller (as opposed to the current operator.)

I went to the nail spa yesterday with a gift certificate that my friend got me a few months ago. The spa owner refused to redeem it since the nail spa is now owned by someone else. The name of the salon never changed, just the ownership and management. They made me pay for the full amount of the spa treatment and said that the owner will call me tomorrow. I'm just wondering if there is anything legal that I can do or say to back me up.
You can take this up with the BBB as a case of deficient services and unfair charges. Sometimes this works, sometimes not.

My daughter bought me a gift card for a therapy place that offered massages. The place closed suddenly with no warning given and the owner moved out of state. At best you are an unsecured creditor, a long way down the pecking order of those with claims on the company. I think the prospects of you getting anything for your gift certificate are close to zero. It is probably not worth the time and trouble to pursue it.
